企业只有给外籍人士同时办理工作许可和居留许可注销后，才被视为与聘用单位劳动关系解除。如工作签证关系仍在原公司，此期间如果外籍人士出现违法，或者人身意外。对公司可能有连带责任。

外籍人士来华工作，提前终止合同、解除聘用关系的，用人单位应当于事项发生之日起10个工作日内向外专局申请注销工作许可。

外国人工作许可证注销业务申办指南

《外国人来华工作许可证》有效期届满未延续的，自动注销。依法被撤销、撤回的，以及许可证件依法被吊销的，由决定机构注销。申请人死亡或者丧失行为能力或者提前终止合同、解除聘用关系的，用人单位应当于事项发生之日起10个工作日内向决定机构申请注销。
